Excellent sales and marketing. I was reviewing the minutes of Bar Council dated 16 October 2014. Apparently SC applications will not be considered if they are conducting mediations and mediation was determined as not being within the SC Protocol (including earlier in 2014). Now it appears that there will be an advice sought as to whether “mediation” is a “legal service”. See BC resolution of 2011 (after motion which I put that mediation was part of “barristers work”) and also article by the then President in 2011. This will affect many barristers’ practices who are working as mediators as well.… Read more »

This is so true. I have personally experienced the turmoil of having a minor dispute unresolved by lawyers seeking to inflame the issue and realise more billable hours. Having accredited mediators rather than lawyers mitigates the risks associated with using lawyers who are corrupted by their own conflicts of interest.
